European Lithium: Court Application for Cleansing Notices and Reinstatement to Trading

26 July 2017 - European Lithium Limited (ASX:EUR, FRA:PF8)(the Company) advises that the cleansing notices issued on 8 June 2017, 15 June 2017 and 3 July 2017 (Cleansing Notices) relating to the issue of ordinary shares on 8, 15 and 30 June 2017 (Shares) were defective.

The Company confirms that it lodged a Cleansing Prospectus with the Australian Securities and Investments Commission on 11 July 2017 to rectify the issue associated with the defective Cleansing Notices and has filed an application with the Federal Court of Australia seeking declaratory relief and ancillary orders relating to the issue of securities and the subsequent offer for sale, or sale, by some of the subscribers of those securities.

The hearing of this application is listed for 26 July 2017 and the Company will continue to advise the market accordingly.

Further to previous ASX announcements in relation to the suspension of its securities, European Lithium Limited (ASX:EUR, FRA:PF8)(the Company) advises that the Company has been successful in obtaining all orders sought at this morning’s Court hearing. The orders were that the offers for sale or sale of the shares issued by the Company on 8, 15 and 30 June 2017 were not invalidated by any failure of the Company to comply with section 707(3) of the Corporations Act 2001 (Cth) and also relieve from civil liability any seller of these shares.

A copy of these orders from the Federal Court of Australia and dated 26 July 2017 has been attached to this announcement.

The ASX has advised that the Company’s securities will be reinstated to trading at market open on 27 July 2017.
